Terms of Use

Article 1 – Definitions

The terms used here have the same meaning as in our Terms and Conditions of Sale. If there's any conflict, the Terms and Conditions of Sale take precedence.

Article 2 – Intellectual Property

The content of the website artists.pro (texts, graphics, logos, etc.) is protected under French and international intellectual property laws, including the Digital Millennium Copyright Act (DMCA) in the U.S. Any reproduction, even partial, is strictly prohibited without prior written authorization from the Vendor.

Article 3 – General User Obligations

3.1 Responsibility for Content

The User is fully responsible for the content they publish or store via the service. We do not proactively monitor user content for legal violations.

3.2 Legal Compliance

The User must comply with applicable laws and regulations (commercial law, intellectual property, data protection, etc.) as well as general ethical standards.

3.3 Respect for Third-Party Rights

The User agrees not to infringe on third-party rights, including personality rights, trademarks, and copyrights.

3.4 Prohibited Content and Fraudulent Practices

It is strictly prohibited to publish illegal content (pornographic, racist, hateful, etc.) or content that infringes third-party rights. The User also agrees not to engage in spamming, fraudulent linking, or hacking. In case of a violation, the User shall compensate the Vendor for damages and cooperate in any investigations.

3.5 Legal Notices

Users must comply with their country's legal notice requirements (such as providing contact information).

3.6 Prohibition of Spamming

Sending unsolicited bulk emails (spam) through our services is strictly prohibited. In case of abuse, the Vendor may restrict or suspend the account without compensation.

3.7 Use of WEKIO Graphics

Graphic elements provided by WEKIO may only be used within the hosted website. Copying or using them on another server is strictly prohibited.

Article 4 – Domain Registration, Cancellation, and Provider Change

4.1 Domain Name Allocation

We act as an intermediary between you and the domain registrar. The Registrar’s rules apply in addition to these Terms of Use. The Vendor does not guarantee the availability of the requested domain name or the absence of prior third-party rights.

4.2 Required Information

The User must provide a valid mailing address, email, and phone number. Any changes must be reported without delay.

4.3 Domain Activation and Limitations

Domain activation may be delayed until payment is fully processed. We cannot guarantee 100% domain availability due to potential technical issues or maintenance.

4.4 Pre-Verification by the User

The User must verify that their chosen domain name does not infringe on any third-party rights. They assume full responsibility in case of disputes.

4.5 Changing a Domain Name After Registration

Subsequent modifications may incur additional fees. In case of a legal dispute, no free replacement is guaranteed.

4.6 Transfer to Another Provider

The User may transfer their domain to another provider, subject to applicable fees and technical conditions. The original contract remains in effect until formal termination.

4.7 Failed Transfer Notifications

If the transfer fails due to inaction by the new provider or the User, the Vendor retains control of the domain.

4.8 Loss of Domain Rights

The User must immediately inform the Vendor if they lose their domain rights (e.g., court decision). The Vendor is not liable for any resulting domain losses.

4.9 Domain Expiration and Public Re-Registration

After the redemption period expires, your domain becomes publicly available and may be registered by someone else. We are not responsible for domain loss after this period.

Article 5 – Availability and Performance

5.1 Service Availability

We strive to maintain service availability 24/7. However, downtime may occur (maintenance, network failures, etc.), and the Vendor shall not be liable beyond the limitations set in Article 7 of the T&Cs.

5.2 Maintenance and Improvements

The Vendor may temporarily restrict access for updates, fixes, or improvements. These maintenance periods are necessary for service quality and do not qualify for compensation.

5.3 Technical Developments

Regular updates are required for system functionality. We are not liable for issues caused by your custom configurations.

Article 6 – Liability

6.1 Data Loss and Unauthorized Access

The Vendor is not liable for data loss or unauthorized access (hacking), except where required by law.

6.2 Abuse of Publicly Accessible Data

The User is solely responsible for the information they make public. The Vendor is not responsible for how third parties use it.

6.3 User Content and Activities

The Vendor assumes no liability for content posted or activities conducted by Users on the service.

6.4 Limitation of Liability

Unless required by law, our liability is limited to 30% of your annual subscription fee (before taxes), as specified in Article 7 of the Terms and Conditions. This does not exclude liability for gross negligence, intentional misconduct, or harm to life, body, or health.

Article 7 – Prohibition of Spam

7.1 Commitment Against Spam

The Vendor may suspend or terminate the account for proven spam activities, without compensation.

Article 8 – Webmail

8.1 Webmail Service

We provide webmail access with 1 GB of storage per email account. Additional storage is available for a fee.

Article 9 – Domain Names

9.1 Free Domain Name

Depending on your subscription plan, you may receive a free domain name (.com, .fr, .be, .eu, .es, .co.uk, .de, .ch, .it, .nl, .li, .pt, .lt, .us, .wf, .tf, .yt, .pm), subject to availability and limited to one free domain per site and per person. The validity period is one year from the date of registration.

9.2 Optional Domain Names and New Extensions

Please note that some domain extensions have variable pricing (standard or premium) and that renewal costs may differ from those advertised at the time of subscription. The rules of the registry apply.

9.3 Renewal Period and Redemption

After your domain expires, you have a 5-day grace period to renew it. After this period, the domain enters a 30-day redemption period, which may incur additional fees. Once the redemption period expires, the domain name is released to the public and may be acquired by a third party, with no liability on the part of the Vendor.
